TERMS OF SALE
Ordering
To place an order, it is imperative to provide complete and accurate information, including your full name, shipping and billing address (excluding P.O. Boxes), telephone number, valid email address, and an accepted payment method. Tom Meinelt Photography disclaims responsibility for misdelivery resulting from inaccurate customer-provided information. We retain the right to reject or cancel any order at our discretion, with the sole recourse for the customer being a refund of any payment(s) made for the affected order.
Changes
Once an order is placed, modifications are generally not possible. An exception exists for changes to the delivery address, permitted only if the order has not yet been shipped. Customers can request such changes by contacting tommeinelt.com customer service via email at tom@tommeinelt.com.
Sales
All sales of Tom Meinelt Photography are considered final, and deposits made are non-refundable. No refunds will be issued.
Payment
Full payment for any order must be made in advance at the time of order placement. Accepted payment methods include credit cards, PayPal, or other means that may be accepted in the future. In the event of a stopped payment, disapproved charge, or failure to submit pre-payment, Tom Meinelt Photography reserves the right to cancel the order. If the order has already been shipped, the customer is liable for all collection costs, including reasonable attorney fees, and may be subject to interest charges at a rate of 1.5% per month (or the highest allowable rate by law if less than 1.5% per month) until payment is made.
Color Matching
Customers acknowledge and understand that the colors seen on a computer monitor may differ from the colors on the final manufactured product. Additionally, there is no guarantee that the colors of an image seen online will precisely match those on the final product.
Personal Data
All information submitted by customers in connection with an order is subject to our Privacy Policy.
Sales Tax
Customers are solely responsible for any applicable state, local, or federal sales, use, VAT, excise, import fees, or other taxes. Tom Meinelt Photography will include such taxes in the order when required to collect them from buyers. If taxes are not included and Tom Meinelt Photography is later required to pay them, the customer is expected to promptly reimburse the seller.
Delivery
Delivery times are contingent on the chosen shipping option during order placement. Allow at least 8-10 weeks for Limited Edition purchases or 1-3 days for retail products to be shipped, in addition to the shipping time based on the selected option. Title and risk of loss pass to the customer upon our delivery to the carrier. In case of a damaged or broken print upon arrival, customers should contact us within 30 days of delivery, providing a picture of the damage, a copy of the shipping receipt, and photographic proof for review. If a replacement is approved, the customer incurs the cost of returning the damaged print and the shipping cost for the new print.
Shipping Charges
All shipping, handling, and insurance charges are the responsibility of the customer and are included in the total order amount. Customers are responsible for international sales orders fees, duties, custom fees, taxes, and charges incurred after purchasing the photography. Customers agree to shipping terms by signing their invoice.
Shipping Problems/Damage Notification of shipping defects or damage must be made within three (3) days of delivery and must be accompanied by the shipping receipt and photographic proof for review.
Cancellations
All works are custom orders, and production begins immediately after purchase. As a result, works cannot be canceled, returned, or refunded. Any request to modify a produced image is subject to a 50% restocking fee. Produced and shipped works are non-cancellable, non-returnable, non-exchangeable, and non-refundable.
Returns
Inspect the Fine Art Photography immediately upon receipt. In case of damage or non-compliance with order specifications, written notification of claim must be provided within three days (3) of delivery acceptance. Claims without original crating/packaging and without a Tom Meinelt Photography Return Authorization Notice (RAN) will not be accepted.
Each Tom Meinelt Limited Edition is custom-produced to order, and changes cannot be made once the order is placed.

eGift Cards
eGift Cards from Tom Meinelt Photography can be used for purchases at tommeinelt.com, and acceptance of an eGift Card constitutes agreement with the accompanying terms and conditions.
General Terms for eGift Cards
Tom Meinelt Photography eGift Cards are distributed by Tom Meinelt Photography LLC. By visiting https://www.tommeinelt.com, customers agree that the laws of the State of California, without regard to principles of conflict of laws, will govern these eGift Card terms and conditions ("Ts & Cs"). Tom Meinelt Photography LLC reserves the right to change these Ts & Cs at its discretion.

eGift Cards Usage
Tom Meinelt Photography eGift Cards are redeemable at www.tommeinelt.com. Customers may not return or cancel Tom Meinelt eGift Cards.

Lost or Stolen eGift Cards
If there is suspicion of an eGift Card being copied or stolen, customers should contact Customer Service at tom@tommeinelt.com immediately. eGift Cards will not be replaced without the purchaser's confirmation email as proof of purchase.
Limitations on eGift Cards
eGift Cards cannot be used to purchase other eGift Cards, reloaded, resold, transferred for value, or redeemed for cash, except as required by law. Unused eGift Cards may not be transferred.
Risk of Loss for eGift Cards
Ownership and risk of loss of eGift Cards pass to the purchaser upon our confirmation to the recipient. Tom Meinelt Photography is not responsible for lost or stolen eGift Cards.

For assistance with eGift Card purchase, ownership, or usage, customers can contact Customer Service at tom@tommeinelt.com, referring to the order number or providing the email address.
Delivery Information and Requirements for eGift Card Purchasers
All eGift Card orders are subject to a verification process comparing purchaser information with the purchaser's financial institution. Discrepancies may result in a delay in the eGift Card order until corrections are made. Tom Meinelt Photography is not responsible for undeliverable eGift Cards due to inaccurate recipient email addresses. Customers are urged to ensure the accuracy of recipient email addresses and contact Customer Service if any issues arise.
Reasons for Failed Delivery
If the recipient's email address is confirmed, but the eGift Card is not viewed within a reasonable period after the requested delivery date, common reasons for delivery failure include spam filters blocking emails, recipient firewalls blocking emails, and email inboxes exceeding size limits. In such cases, customers should modify email options to prevent blocking and ensure proper delivery.

Limitation of Liability
Tom Meinelt Photography LLC and its affiliates make no warranties, express or implied, with respect to eGift Cards, including any express or implied warranty of merchantability or fitness for a particular purpose. In case of a non-functional eGift Card code, the sole remedy and liability rest with the replacement of the gift card. Certain state laws may not allow limitations on implied warranties or the exclusion or limitation of certain damages. If applicable laws provide additional rights, some or all of the disclaimers, exclusions, or limitations may not apply.
Copyright and Reproduction
All copyrights and trade rights to Fine Art Photography are expressly reserved to Tom Meinelt Photography. This agreement does not involve the sale or license of the Copyright to the customer. Customers are prohibited from reproducing or copying Tom Meinelt Photography. The artist receives authorship credit at all times. Tom Meinelt 's name, signature, logo, and all related product and service names, design marks, and slogans are registered trademarks. All intellectual property rights are expressly reserved. Customers must not infringe on any copyright, trademark, trade secrets, logo, patent, or other intellectual property rights.
General
All orders and transactions are subject to the tommeinelt.com Terms of Use policy, including limitations on damages and exclusions of warranties. The Terms of Use also encompass provisions for dispute arbitration and other essential terms. Descriptions, images, references, features, content, specifications, products, price, and availability may change without notice. The latest prices are available on our Sites and Apps. No responsibility is assumed for errors in listed prices or information, and we reserve the right to correct any such errors. Orders are not final or binding until accepted by us. We reserve the right, with or without prior notice, to limit the available quantity of any product or service, discontinue products or services, impose conditions on honoring coupons or promotional codes, bar users from making purchases, and refuse to provide products or services. Tommeinelt.com is not liable for any delay or failure in delivery due to causes beyond its control, including acts of god, war, terrorism, embargo, quarantine, accidents, fire, explosion, flood, severe weather, epidemic, riots, civil disturbance, unavailability of labor or transportation, or any other similar or dissimilar cause. Customers are responsible for the proper and safe handling of any prints or other products ordered from us. To the extent allowed by law, tommeinelt.com’s liability for any claim related to any product purchased from us is limited to the amount paid for the product.
